TELT company is the public developer in charge of building and managing the cross-border section of the the new Lyon-Turin railway link project. This transalpine link is a mixed passenger/freight rail project linking up France and Italy. The cross-border section is about 65 km long between Saint-Jean-de-Maurienne (Savoy) and Susa/Bussoleno (Piedmont). The value of the entire project has been estimated at EUR 8.6 billion.

To the extent that the law governing the bidding and awarding of this public contract is the French law, the contract notice published in French for this procurement contract is the only one to be considered if different from the present notice in English or from the notice in Italian, which are to be considered as courtesy translations.

Except for the Excel file mentioned in III.1.2) above, there is no procurement documents available to the candidates. Interested candidates will only have to provide, before the deadline mentioned in IV.2.2) above, a candidate dossier including all the documents and information described above. Candidates will have to submit their bid solely via the dematerialisation platform, at the following address: https://telt.achatpublic.com/accueil/.

Each transmission will be associated to a certified receipt date and it will produce an electronic receipt. The application may include a backup copy, delivered by hand against receipt or sent by express mail with acknowledgement of receipt to the address provided in I.1). All bids, including all backup copies, which are delivered after the date and hour specified will be declared as beyond the deadline and rejected. It is up to the candidates to verify and make sure that their dossier has arrived before the deadline.

Selected candidates shall receive a tender file whereby they shall be invited to submit their bids within a specified timeframe. Thereafter, the successful tenderer of each lot shall be chosen after negotiation, where necessary. It is hereby understood that, pursuant to article R.2161-23 of the French Public Procurement Code, TELT reserves the right not to negotiate with the bidders, and to award the contract on the basis of the initial tenders.

In case of negotiation, only those bidders offering a coinsurance percentage equal to or higher than the following minimum amount will be admitted:

— Lots 1 and 2: 30 % of the coverage amount;

— Lot 3: 20 % of the coverage amount.

In case of negotiation, TELT reserves the right to gradually restrict the number of bidders allowed to negotiate as the negotiation phases unfold. The bidder whose bid is ranked in first position on completion of the analysis of final bids will be appointed as lead insurer. If this offer does not have insurance coverage of 100 %, negotiations will be initiated with the other bidders, according to their ranking after the analysis of final bids, to enable them to be co-insurers until the entire risk is covered. The enterprise grouping including the lead insurer and any other bidders who are now co-insurers will be awarded the contract.

This contract is subject to:

— Italian law No 191/2009 pertaining to construction work items with regard to procedures for financing of the project by the Italian State; these rules will conform to European Union laws and regulations;

— the rules on the fight against Mafia infiltrations agreed by the French and Italian governments and brought into force via the Contract Regulation approved by the CIG (Inter-Governmental Committee), published in France as part of Decree n. 2017-432 of 5 April 2017 and in force since 9 April 2018, in its updates.
