This tender relates to the long term leasing of light corporate vehicles (under 3, 5 T) for EDF and its French subsidiaries listed below.
The related services include: the maintenance, repair, pneumatic service, assistance, and replacement vehicle of the same category following failure or disaster, the transportation of vehicles for maintenance work or for the delivery of the vehicle or his restitution.
The concerned entities are:
— ERDF, DALKIA, CITELUM, SOCODEI, EDF PEI, CHAM, EDF Energies nouvelles, EDF EN France, EDF EN Services, EDF EN Outre Mer, EDF ENR PWT, EDF ENR Solaire, TIRU and EDF.
EDF is acting on its own name and on behalf of its French subsidiaries listed in Annex A.
Stipulation on behalf of a third party:
The candidate, in case of potential award of the contract, undertakes to grant the benefice of the prices, commercial terms and conditions of this contract to all entities which will be mentioned on the Document ‘ Rules of the Call for Tender ’, at their first request, if they want to beneficiate of these conditions. This document will be available during the call for tender.

Conditions de participation
Habilitation à exercer l'activité professionnelle:

All the Candidates must provide the following required documents with regards to each criterion requested, in french language. The documents shall be attached in the RFI (Request For Informations) Reference: ‘RFx_018053’, on ‘pha.edf.com’ (your registration is necessary on this purchasing portal).

The following cannot tender:

1) Those candidates who have, within the last 5 years, been handed down a final sentence for one of the offences provided for in articles 222-38, 222-40, 225-1, 226-13, 313-1 to 313-3, 314-1 to 314-3, 324-1 to 324-6, 413-9 to 413-12, 421-1 to 421-2-3, subparagraph 2 of article 421-5, article 433-1, subparagraph 2 of article 433-2, subparagraph 8 of article 434-9, subparagraph 2 of article 434-9-1, articles 435-3, 435-4, 435-9, 435-10, 441-1 to 441-7, 441-9, 445-1 and 450-1 of the French Penal Code, article 1741 of the French General Tax Code and articles L. 2339-2 to L. 2339-4, L. 2339-11-1 to L. 2339-11-3 of the French Defence Code and L. 317-8 of the French Interior Security Code.

2) Those candidates who, within the last 5 years, have been handed down a sentence listed on Report n° 2 of the Criminal Records Bureau for the offences referred to in articles L. 1146-1, L. 8221-1, L. 8221-3, L. 8221-5, L. 8231-1, L. 8241-1, L. 8251-1 and L 8251-2 of the French Labour Code.

3) Those candidates subject to the compulsory liquidation proceedings provided for in article L. 640-1 of the French Commercial Code, those individuals whose personal bankruptcy has been pronounced under articles L. 653-1 to L. 653-8 of the same Code as well as those persons subject to equivalent proceedings under a foreign law jurisdiction.

Candidates admitted to the compulsory reorganization proceedings laid down by article L. 631-1 of the French Commercial Code or to equivalent proceedings under a foreign law jurisdiction must provide evidence that they have been authorized to continue their activities throughout the foreseeable term of execution of the contract.

4) Those candidates who, on 31 December of the year preceding that during which the tender is launched, have not fulfilled their obligations in terms of tax and social security declarations or have not paid the tax and contributions payable on that date. However, the following shall be regarded as eligible candidates: those candidates who, on 31 December of the year preceding that during which the tender is launched, have not paid the various amounts due on that date or provided any guarantees, but who have, before the date of the launch of the tender and without any enforcement measures having been taken by the accountant or the agency responsible for collection, either paid the said amounts or provided guarantees deemed sufficient by the accountant or the agency responsible for collection. Individuals who are legal or de facto directors of a legal entity that does not satisfy the conditions provided for in this subparagraph may not personally tender for a contract.

5) Those candidates who, on 31 December of the year preceding that during which the tender is launched, have not implemented the obligation to negotiate provided for in article L. 2242-5 of the French Labour Code and who, at the date on which they tender, have not completed or engaged the regularization of their situation.

In order to provide evidence that it is not in one of the situations cited in points 1) to 5) above, the candidate must furnish a sworn statement, dated and signed.

These conditions are applicable to the candidates and to each of the members of a group wishing to tender as a single candidate.

Situation économique et financière:

All the Candidates must provide the following required documents with regards to each criterion requested, in French language. The documents shall be attached in the RFI (Request For Informations) Reference: ‘RFx_018053’, on ‘pha.edf.com’ (your registration is necessary on this purchasing portal).

The documents required are:

1/ For the Economic and financial criteria n°1:

— The applicant must provide the proof of an average annual turnover of 105 000 000 EUR over the last 3 years.

— In case of consortium, the financial ability is the financial capacity of the consortium and not the financial capacity of each member of the group.

2/ For the Economic and financial criteria n°2:

— The applicant must have a strong financial base (with profits realized during these last 3 years).

In order to prove this, please attach:

> your last 3 balance sheets and P&L statements,

> your 3 last statements of intermediate balances (main financial indicators)

> and a bank statement certifying the good financial situation of your company.

— For the consortium (companies of the consortium are liable for the entire contract), necessity to attach the aforementioned documents for each member of the consortium.

Capacité technique et professionnelle:

— Technical criteria:

1/ Exert rentals long term activity for company vehicles

> In order to fulfill this criterion, the candidate will have to provide us with a presentation of maximum 5 pages detailing this competency.

The solutions, products and related services for long term rentals activity shall be detailed in the presentation in the form of a recap table for each solution and across Group.

2/ Company managing a fleet of at least 20 000 vehicles in mainland France.

> To fulfill this criterion, the candidate will have to provide us the appropriate documentation

3/ The Candidate must be able to provide statistics of all forms (paper, internet, formatted files...) and periodicities (annually, quarterly and monthly). Details have to be: specific per country, per solution, per category, in volume, consolidated at a Group level, at the national level, at the level of units, at the level of subsidiaries and wide group (Consolidated Statistics).

Also: The Candidate must be able to propose simplified managing tools to follow up spend.

>To fulfill this criterion, the candidate will have to provide us with examples of the data/files that they can provide us to prove that they have this capacity for the whole Group.

4/ Being able to propose leasing vehicles (long term rental vehicles) in Corsica and in The French overseas departments and territories.

5/ The Candidate must provide a document, certifying that he will respect the confidentiality of any kind of information that he will receive from EDF.

Exécution du marché
Dépôts et garanties exigés: No deposit or guarantees will be required.

Own resources funding.

Payments are monthly made, by transfer, in arrears, in thirty days from the date of broadcast(emission,issue) of the invoice, under the condition that this one is recognized good to pay.

If you respond to this Tender as a consortium (group of economic operators), the potential award of the contract to this consortium could lead the consortium to a severally liable and joint consortium status once the contract is awarded.
