The activities of this lot n. 1 include the transfer of existing facilities (especially declines and Avrieux shaft) and the construction of all future base tunnel facilities over a distance of roughly 21.9 km for each tube, running from Modane up to the adjoining section in Italy.

The works to be carried out by means of purchase orders may especially include:

— construction of the Villarodin-Bourget platform (fence, earthworks, dikes, power supply, site ventilation, pit water treatment, other site facilities),

— civil engineering works on the Modane safety site and the related service galleries (digging using conventional methods, supports, waterproofing, and surfacing/paving) from the foot of the Villarodin-Bourget/Modane decline,

— civil engineering works on the base tunnel (digging using conventional methods and/or tunnel boring machine, supports, waterproofing and surfacing/paving) as well as the related intertube galleries and service/utility rooms,

— civil engineering works to reconstruct the Villarodin-Bourget/Modane decline in its final dimensions,

— construction of all facilities needed to provide site logistics and backup (temporary or permanent facilities, underground works, utilities, etc...),

— construction of sites for pre-classification of excavated materials for subsequent reuse and of sites for the temporary or permanent storage of materials deriving from underground earthworks and excavations (moulin and tierces sites),

— the stocking and transportation of excavated materials via conveyor belt.

Works to be carried out through follow-on contracts (initiated or not depending on the operational date of the lot in charge of testing, sorting and reusing the excavation materials) involve the management and use of excavation materials, which may include all or some of the following services:

— testing, sorting and final classification of excavation materials,

— transfer of excavation materials to temporary or permanent disposal sites,

— earthworks to allow for permanent storage on the tierces site.

Follow-on contracts may also allow for civil engineering works to be carried out to construct tunnel structures that will interface with future equipment contracts.

The scope of this “Operational Worksite 5" lot may undergo limited changes in relation to the perimeters of “Operational Worksite 4" to the east and “Operational Worksite 6" to the west, based on the actual progress of each of the worksites and the need to keep the project implementation programme within the expected timeframes.

— additional civil engineering works on the tube running between the La Praz safety site and the Operational Worksite 7 (waterproofing and surfacing/paving).

For operational worksite 7 (CO7):

— construction of the Saint-Martin-la-Porte platform (fence, earthworks, dikes, power supply, site ventilation, pit water treatment, other site facilities),

— civil engineering works at the foot of the Saint-Martin-la-Porte decline for construction of the second tube, including the tunnel boring machine assembly cavern as well as the related intertube galleries and service/utility rooms,

— civil engineering works on the second tube of the base tunnel of approximately 8 km long between the foot of the Saint-Martin-la-Porte decline and the foot of the La Praz decline (digging using conventional methods and/or tunnel boring machine) as well as the related intertube galleries and service/utility rooms,

— additional civil engineering works on the existing tube running between…

… Saint-Martin-la-Porte and La Praz (surfacing/paving, drainage, clean-up, laying of grouted-aggregate concrete),

… the 2 branches of the Saint-Martin-la-Porte decline (reboring where needed, supports, waterproofing and surfacing/paving), partly going through productive coal strata,

— civil works on the base tunnel (digging using conventional methods) towards Saint-Julien-Montdenis up to the junction with the adjacent work item.

For operational worksites 6 and 7 (CO6/7):

— construction of all facilities needed to provide logistics and back-up (temporary and/or permanent facilities, underground works, utilities, etc.),

— construction of sites for the pre-sorting of excavated materials for future reuse, as well as temporary and permanent disposal sites for materials deriving from earthworks and underground excavation,

— construction of the Villard-Clément worksite platform (fence, earthworks, dikes, power supply, site ventilation, pit water treatment, other site facilities),

— temporary supports needed for earthworks to construct the attack point of the base tunnel,

— earthworks needed to construct the attack point of the base tunnel and the cut-and-cover tunnel linked with the one already completed,

— civil engineering works on the 2 tubes of the base tunnel over a distance of 1,8 km to 4 km (digging, supports, waterproofing and surfacing/paving), as well as the related intertube galleries and service/utility rooms,

— civil engineering works on the cut-and-cover tunnel linked with the one already constructed under Operational Worksite 9a and the base tunnel entrance, over roughly 150 m, plus the permanent back filling on the facility itself,

— construction of all facilities needed to provide logistics and back-up (temporary and/or permanent facilities, underground works, utilities, etc...),

— construction of sites for the pre-sorting of excavated materials for future reuse and temporary disposal,

The scope of this “Operational Worksite 8” lot may undergo limited changes within the perimeters of “Operational Worksite 7” to the east, based on the actual progress of each of the worksites and the need to keep the project implementation programme within the expected timeframes.

Each economic operator, acting alone or in a consortium must present:

— either forms DC1 and DC2 or their equivalents, freely available at the following address: http://www.economie.gouv.fr/daj/formulaires-declaration-du-candidat (in case of consortium/venture, the DC1 form must be provided only by the consortium/venture representative),

— or the European Single Procurement Document (ESPD), or their equivalents for bidders that are not based in European Union; it must be understood in that TELT does not authorise candidates to mention in the European Single Procurement Document or the equivalent that they are equipped with the required skills and capabilities without providing specific details on same.

Economic operators subject to the italian law will also have to provide the following documents:

— the social security contributions payment certificate (DURC),

Situation économique et financière:

Each economic operator, acting alone or in a consortium/venture, must prove that it has the required economic, asset and financial capabilities by presenting the following:

— certified financial statements (including income statement) available for the financial years 2015, 2016 and 2017 (or equivalent for non-french candidates),

— a filled copy of the Excel file “bilans financiers” (financial statements) available at the following address: https://telt.achatpublic.com/accueil/,

— an insurance certificate for occupational risks specifying the guaranteed capital value.

Niveau(x) minimal/minimaux de normes:

The minimum annual turnover required of candidates for each of the 3 years 2015, 2016 and 2017 (for consortiums/ventures, this should be understood as the cumulative turnover of all member companies and, eventually, that of the contractors involved alongside the candidate whatever their legal ties) is:

— 220 000 000 EUR excl. taxes for lot n. 1 (operational worksite 5),

— 220 000 000 EUR excl. taxes for lot n. 2 (operational worksite 6/7),

— 30 000 000 EUR excl. taxes for lot n. 3 (operational worksite 8).

The turnover corresponds to the turnover available according to accessible data, based on the foundation date of the company or on the starting date of activities for an economic operator. If the candidate is unable to provide the turnover required, it will be allowed to prove its financial capacities via any other document recognised as an equivalent.

Capacité technique et professionnelle:

Each economic operator, acting alone or as a consortium/venture, must demonstrate it has sufficient technical and professional capabilities by providing:

1) Human and material resources:

— a declaration of its annual average staff headcount and the size of its managerial staff for the last 3 years,

— a description of the tools and equipment it shall use to execute this framework contract.

2) Professional references:

— a list of projects it has executed over the last 10 years.

3) Quality certifications:

— its quality certificates (e.g. ISO 9001, 14001, 18001 or equivalents).

Niveau(x) minimal/minimaux de normes:

Concerning professional references, the candidate must provide at least a current reference or obtained within the last ten years for each of the following components of the following work items (in case of consortiums/ventures, one reference per consortium is sufficient):

Lot n. 1 (operational worksite 5) and Lot n. 2 (operational worksite 6/7):

— tunnel with an excavated section of at least 60 m

— cavern with a section of more than 250 m

— mechanised excavation on a length of more than 5 km,

— project with excavation and concurrent surfacing/paving from several attack fronts,

— management of material stocks of more than 200 000 m

Lot n. 3 (operational worksite 8):

— tunnel dug using conventional methods on a length of at least 500 m and with a section of at least 60 m

— tunnel dug using conventional methods through rocky terrains with a section of at least 60 m

— tunnel dug using conventional methods through loose terrain with a section of at least 60 m

— cut-and-cover civil engineering works on a length of at least 50 m with an interior section of at least 40 m

— support structure with a height of more than 10 m,

— earthworks with a volume of more than 100 000 m

— earthworks in the presence of water with treatment of seepage (such as water plugs, soil injection or pumping).

Candidates are not allowed to provide more than 5 references per item. Should they provide more than 5 references, only the first 5 consulted will be considered.

Each reference must be written using the table available on TELT’s dematerialisation platform (http://telt.achatpublic.com/accueil/). This table containing the candidate's role, turnover share and scope of technical services of each economic operator concerned, as well as the specific addresses of the clients concerned, should be provided with certificates of satisfactory performance, if possible.

If the candidate is unable to provide the proof of technical and professional abilities required, it will be allowed to prove them via any other document recognised as an equivalent.

Candidates will be selected on the basis of their economic, financial, technical and professional abilities, according to the documents provided with their bids, and after the exclusion of all candidatures judged inadmissible.

Exécution du marché
Dépôts et garanties exigés:

A contract holdback of 5 % of the value of the service shall be applied to each purchase order and follow-on contract. This holdback may be replaced at the holder's discretion with a first-demand guarantee. The holder shall not replace it with a joint and personal guarantee.

This framework contract is financed by the European Union, Italy and France.

Payments for services shall be made by bank transfer within 45 days effective from the date of receipt of the related invoice. Each purchase order shall be based on unit prices that will be adjusted, each follow-on contract shall be based on lump sums or unit prices that may be adjusted or not.

Forme juridique que devra revêtir le groupement d'opérateurs économiques attributaire du marché:

Candidates may bid as individual companies or as consortiums/ventures. For each lot, the same legal person shall neither combine both approaches nor represent several consortiums/ventures. Once the contract is awarded, the form of consortium/venture required by TELT shall be the mixed form with a jointly-liable representative. The mixed form is justified by the diversity of the skills requested and the missions required, both of which are highly specialised. Each of the co-contractors must therefore be committed solely to the component of the contract where it is engaged. As to the representative's joint liability, it allows for the satisfactory performance of the whole service to be guaranteed and for remedial measures to be proposed to the project owner, should any co-contractor default on its obligation.

Conditions d'exécution du contrat:

Authorisations from the administration relative to site facilities, utilities, transportation, execution of works 24/7, employment of workers, use of explosives shall be required. The contract holder shall take all steps necessary to obtain these documents from all competent authorities.

This framework contract will also contain an employment promotion clause aimed at facilitating the professional integration of disadvantaged persons (number of working hours required from integrated persons).

The award restrictions mentioned in II.1.6 above apply also in the case of consortiums/ventures with different consortium/venture representative, but comprised of the same members.

The duration mentioned in II.2.7 is the period of time during which the purchase orders and follow-on contracts should be produced. The tentative duration for the execution of works (outside the preparation and warranty periods) is of 72 months for lot 1, 68 months for lot 2, and 68 months for lot 3.

It is specified that the reference language for the adjudication of this public contract is French. Any translation of this call for tenders in Italian or English is to be considered a courtesy translation.

Except for the Excel file and the reference table mentioned in III.1.2 and III.1.3 above respectively, there is no procurement documents available to the candidates. Interested candidates will only have to provide, before the deadline mentioned in IV.2.2 above, a candidate dossier including all the documents and information described above. Candidates will have to submit their bid uniquely via the dematerialisation platform, at the following address: http://telt.achatpublic.com/accueil/. Each transmission will be associated to a certified receipt date and it will produce an electronic return receipt. The application dossier may include a backup copy, delivered by hand against receipt or sent by express mail with acknowledgement of receipt to the address provided in I.1. All bids, including all backup copies, which are delivered after the date and hour specified will be declared as beyond the deadline and rejected. It is up to the candidates to verify and make sure that their dossier has arrived before the deadline.

Selected candidates shall receive a tender file whereby they shall be invited to submit their bids within a specified timeframe. Thereafter, the successful tenderer of each lot shall be chosen after negotiation, where necessary. It is hereby understood that, pursuant to article R.2161-23 of the Public Procurement Code (former article 74 of Decree n. 2016-360 on public procurement), TELT reserves the right to gradually restrict the number of bidders allowed to negotiate as the negotiation phases unfold.

This contract is subject to:

— Italian law n. 191/2009 on construction work items with regard to procedures for financing of the project by the Italian State; these rules will conform to European Union laws and regulations,

— the rules on the fight against Mafia infiltrations agreed by the French and Italian governments and brought into force via the Contract Regulation approved by the CIG (Intergovernmental Commission) and published as part of Decree n. 2017-432 of 5.4.2017 and in force since 9 April 2018, in its consolidated version.

In accordance with article R.2185-1 of the Public Procurement Code (former article 98 of Decree n. 2016-360), candidates and bidders are reminded that the tender can be withdrawn, at any moment of the procedure, up until the signing of the contract. In this case, bidders do not have any right to sign the contract, or to be reimbursed for the expenses they incurred as part of their application. The tender can be withdrawn by the Contracting Entity because of economic, legal, or technical reasons, or following a decision of the 2 States.

Finally, the successful tenderer of each lot of this public tender agrees to respect TELT’s code of ethics (freely downloadable from the following address: http://www.telt-sas.com/fr/statut-code-ethique-accords), and also ensure that it is observed by its employees, co-contractors and subcontractors.

The works to be carried out by means of purchase orders may especially include :

- construction of the Villarodin-Bourget platform (fence, earthworks, dikes, power supply, site ventilation, pit water treatment, other site facilities);

- civil engineering works on the Modane safety site and the related service galleries (digging using conventional methods, supports, waterproofing and surfacing/paving) from the foot of the Villarodin-Bourget/Modane decline;

- civil engineering works on the base tunnel (digging using conventional methods and/or tunnel boring machine, supports, waterproofing and surfacing/paving) as well as the related intertube galleries and service/utility rooms;

- civil engineering works to reconstruct the Villarodin-Bourget/Modane decline in its final dimensions;

- construction of all facilities needed to provide site logistics and backup (temporary or permanent facilities, underground works, utilities, etc...);

- construction of sites for preclassification of excavated materials for subsequent reuse and of sites for the temporary or permanent storage of materials deriving from underground earthworks and excavations (Moulin and Tierces sites);

- the stocking and transportation of excavated materials via conveyor belt.

- testing, sorting and final classification of excavation materials;

- transfer of excavation materials to temporary or permanent disposal sites;

- earthworks to allow for permanent storage on the Tierces site.

The scope of this "Operational Worksite 5" lot may undergo limited changes in relation to the perimeters of "Operational Worksite 4" to the east and "Operational Worksite 6" to the west, based on the actual progress of each of the worksites and the need to keep the project implementation programme within the expected timeframes.

Brève description:

The activities of this lot n. 2 include the transfer of existing facilities (especially declines) and the construction of all future base tunnel facilities over a distance of roughly 23.1 km, running from Saint-Martin-la-Porte up to Modane.

For operational worksite 6 (CO6) :

- construction of the La Praz platform (fence, earthworks, dikes, power supply, site ventilation, pit water treatment, other site facilities);

- civil engineering works on the La Praz safety site and the related service galleries (digging using conventional methods) from the foot of the La Praz decline;

- civil engineering works on the base tunnel section of approximately 9 km long between the La Praz caverns and the Modane safety site (digging using conventional methods and/or tunnel boring machine) as well as the related intertube galleries and service/utility rooms;

- additional civil engineering works on the tube running between the La Praz safety site and the Operational Worksite 7 (waterproofing and surfacing/paving).

For operational worksite 7 (CO7) :

- construction of the Saint-Martin-la-Porte platform (fence, earthworks, dikes, power supply, site ventilation, pit water treatment, other site facilities);

- civil engineering works at the foot of the Saint-Martin-la-Porte decline for construction of the second tube, including the tunnel boring machine assembly cavern as well as the related intertube galleries and service/utility rooms;

- civil engineering works on the second tube of the base tunnel of approximately 8 km long between the foot of the Saint-Martin-la-Porte decline and the foot of the La Praz decline (digging using conventional methods and/or tunnel boring machine) as well as the related intertube galleries and service/utility rooms;

- additional civil engineering works on the existing tube running between…

… Saint-Martin-la-Porte and La Praz (surfacing/paving, drainage, clean-up, laying of grouted-aggregate concrete);

… the two branches of the Saint-Martin-la-Porte decline (reboring where needed, supports, waterproofing and surfacing/paving), partly going through productive coal strata;

- civil works on the base tunnel (digging using conventional methods) towards Saint-Julien-Montdenis up to the junction with the adjacent work item.

For operational worksites 6 and 7 (CO6/7) :

- construction of all facilities needed to provide logistics and back-up (temporary and/or permanent facilities, underground works, utilities, etc.);

- construction of sites for the pre-sorting of excavated materials for future reuse, as well as temporary and permanent disposal sites for materials deriving from earthworks and underground excavation.

- transfer of excavation materials to temporary or permanent disposal sites.

The scope of this "CO 6/7" lot may undergo limited changes in relation to the perimeters of "Operational Worksite 5" to the east and "Operational Worksite 8" to the west, based on the actual progress of each of the projects and the need to keep the project implementation programme within the expected timeframes

Brève description:

The activities of this lot n. 3 include the transfer of existing facilities (especially the cut-and-cover tunnel of Saint-Julien-Montdenis and related facilities) and construction of all future base tunnel facilities over a distance of roughly 1.8 to 4 km in the immediate vicinity of Villard-Clément.

- construction of the Villard-Clément worksite platform (fence, earthworks, dikes, power supply, site ventilation, pit water treatment, other site facilities);

- temporary supports needed for earthworks to construct the attack point of the base tunnel;

- earthworks needed to construct the attack point of the base tunnel and the cut-and-cover tunnel linked with the one already completed.

- civil engineering works on the two tubes of the base tunnel over a distance of 1.8 to 4 km (digging, supports, waterproofing and surfacing/paving), as well as the related intertube galleries and service/utility rooms;

- civil engineering works on the cut-and-cover tunnel linked with the one already constructed under Operational Worksite 9a and the base tunnel entrance, over roughly 150 m, plus the permanent backfilling on the facility itself;

- construction of all facilities needed to provide logistics and back-up (temporary and/or permanent facilities, underground works, utilities, etc...);

- construction of sites for the pre-sorting of excavated materials for future reuse and temporary disposal;

The scope of this "Operational Worksite 8" lot may undergo limited changes within the perimeters of "Operational Worksite 7" to the east, based on the actual progress of each of the worksites and the need to keep the project implementation programme within the expected timeframes.

- the contractual interlocutory procedure (article L.551-13 of the french Administrative Justice Code), which can be started within 31 days from the publication of an award notice on the OJEU or within 6 months from the day after the conclusion of the public tender if no award notice is published;

- an appeal contesting the validity of the contract or of some of its advertising clauses in front of a litigation judge, which can be lodged within two months following all adequate advertising measures.
