Once the contract is awarded, the form of consortium/venture required by TELT shall be the mixed form with a jointly-liable representative. The mixed form is justified by the diversity of the skills requested and the missions required, both of which are highly specialised. Each of the co-contractors must therefore be committed solely to the component of the contract where it is engaged. As to the representative's joint liability, it allows for the satisfactory performance of the whole service to be guaranteed and for remedial measures to be proposed to the project owner, should any co-contractor default on its obligation.

The duration mentioned in II.2.7 is the period of time during which the purchase orders and follow-on contracts should be produced. The tentative duration for the execution of works (outside the preparation and warranty periods) is of 72 months for lot 1, 68 months for lot 2, and 68 months for lot 3.
It is specified that the reference language for the adjudication of this public contract is French. Any translation of this call for tenders in Italian or English is to be considered a courtesy translation.
Except for the Excel file and the reference table mentioned in III.1.2 and III.1.3 above respectively, there is no procurement documents available to the candidates. Interested candidates will only have to provide, before the deadline mentioned in IV.2.2 above, a candidate dossier including all the documents and information described above. Candidates will have to submit their bid uniquely via the dematerialisation platform, at the following address: http://telt.achatpublic.com/accueil/. Each transmission will be associated to a certified receipt date and it will produce an electronic return receipt. The application dossier may include a backup copy, delivered by hand against receipt or sent by express mail with acknowledgement of receipt to the address provided in I.1. All bids, including all backup copies, which are delivered after the date and hour specified will be declared as beyond the deadline and rejected. It is up to the candidates to verify and make sure that their dossier has arrived before the deadline.
Selected candidates shall receive a tender file whereby they shall be invited to submit their bids within a specified timeframe. Thereafter, the successful tenderer of each lot shall be chosen after negotiation, where necessary. It is hereby understood that, pursuant to article R.2161-23 of the Public Procurement Code (former article 74 of Decree n. 2016-360 on public procurement), TELT reserves the right to gradually restrict the number of bidders allowed to negotiate as the negotiation phases unfold.
This contract is subject to:
— Italian law n. 191/2009 on construction work items with regard to procedures for financing of the project by the Italian State; these rules will conform to European Union laws and regulations,
— the rules on the fight against Mafia infiltrations agreed by the French and Italian governments and brought into force via the Contract Regulation approved by the CIG (Intergovernmental Commission) and published as part of Decree n. 2017-432 of 5.4.2017 and in force since 9 April 2018, in its consolidated version.
In accordance with article R.2185-1 of the Public Procurement Code (former article 98 of Decree n. 2016-360), candidates and bidders are reminded that the tender can be withdrawn, at any moment of the procedure, up until the signing of the contract. In this case, bidders do not have any right to sign the contract, or to be reimbursed for the expenses they incurred as part of their application. The tender can be withdrawn by the Contracting Entity because of economic, legal, or technical reasons, or following a decision of the 2 States.

The activities of this lot n. 1 include the transfer of existing facilities (especially declines and Avrieux shaft) and the construction of all future base tunnel facilities over a distance of roughly 21.9 km for each tube, running from Modane up to the adjoining section in Italy.
The works to be carried out by means of purchase orders may especially include :
- construction of the Villarodin-Bourget platform (fence, earthworks, dikes, power supply, site ventilation, pit water treatment, other site facilities);
- civil engineering works on the Modane safety site and the related service galleries (digging using conventional methods, supports, waterproofing and surfacing/paving) from the foot of the Villarodin-Bourget/Modane decline;
- civil engineering works on the base tunnel (digging using conventional methods and/or tunnel boring machine, supports, waterproofing and surfacing/paving) as well as the related intertube galleries and service/utility rooms;
- civil engineering works to reconstruct the Villarodin-Bourget/Modane decline in its final dimensions;
- construction of all facilities needed to provide site logistics and backup (temporary or permanent facilities, underground works, utilities, etc...);
- construction of sites for preclassification of excavated materials for subsequent reuse and of sites for the temporary or permanent storage of materials deriving from underground earthworks and excavations (Moulin and Tierces sites);
- the stocking and transportation of excavated materials via conveyor belt.
Works to be carried out through follow-on contracts (initiated or not depending on the operational date of the lot in charge of testing, sorting and reusing the excavation materials) involve the management and use of excavation materials, which may include all or some of the following services :
- testing, sorting and final classification of excavation materials;
- transfer of excavation materials to temporary or permanent disposal sites;
- earthworks to allow for permanent storage on the Tierces site.
Follow-on contracts may also allow for civil engineering works to be carried out to construct tunnel structures that will interface with future equipment contracts.

The works to be carried out by means of purchase orders may especially include :
For operational worksite 6 (CO6) :
- construction of the La Praz platform (fence, earthworks, dikes, power supply, site ventilation, pit water treatment, other site facilities);
- civil engineering works on the La Praz safety site and the related service galleries (digging using conventional methods) from the foot of the La Praz decline;
- civil engineering works on the base tunnel section of approximately 9 km long between the La Praz caverns and the Modane safety site (digging using conventional methods and/or tunnel boring machine) as well as the related intertube galleries and service/utility rooms;
- additional civil engineering works on the tube running between the La Praz safety site and the Operational Worksite 7 (waterproofing and surfacing/paving).
For operational worksite 7 (CO7) :

- civil engineering works at the foot of the Saint-Martin-la-Porte decline for construction of the second tube, including the tunnel boring machine assembly cavern as well as the related intertube galleries and service/utility rooms;
- civil engineering works on the second tube of the base tunnel of approximately 8 km long between the foot of the Saint-Martin-la-Porte decline and the foot of the La Praz decline (digging using conventional methods and/or tunnel boring machine) as well as the related intertube galleries and service/utility rooms;
- additional civil engineering works on the existing tube running between Saint-Martin-la-Porte and La Praz (surfacing/paving, drainage, clean-up, laying of grouted-aggregate concrete);
- additional civil engineering works on the existing tube running between the two branches of the Saint-Martin-la-Porte decline (reboring where needed, supports, waterproofing and surfacing/paving), partly going through productive coal strata;

The activities of this lot n. 3 include the transfer of existing facilities (especially the cut-and-cover tunnel of Saint-Julien-Montdenis and related facilities) and construction of all future base tunnel facilities over a distance of roughly 1.8 to 4 km in the immediate vicinity of Villard-Clément.
The works to be carried out by means of purchase orders may especially include :
- construction of the Villard-Clément worksite platform (fence, earthworks, dikes, power supply, site ventilation, pit water treatment, other site facilities);
- temporary supports needed for earthworks to construct the attack point of the base tunnel;
- earthworks needed to construct the attack point of the base tunnel and the cut-and-cover tunnel linked with the one already completed.
- civil engineering works on the two tubes of the base tunnel over a distance of 1.8 to 4 km (digging, supports, waterproofing and surfacing/paving), as well as the related intertube galleries and service/utility rooms;
- civil engineering works on the cut-and-cover tunnel linked with the one already constructed under Operational Worksite 9a and the base tunnel entrance, over roughly 150 m, plus the permanent backfilling on the facility itself;

The duration mentioned in II.2.7 is the period of time during which the purchase orders and follow-on contracts should be produced. The tentative duration for the execution of works (outside the preparation and warranty periods) is of 72 months for lot 1, 68 months for lot 2, and 68 months for lot 3.
It is specified that the reference language for the adjudication of this public contract is French. Any translation of this call for tenders in Italian or English is to be considered a courtesy translation.
Except for the Excel file and the reference table mentioned in III.1.2 and III.1.3 above respectively, there is no procurement documents available to the candidates. Interested candidates will only have to provide, before the deadline mentioned in IV.2.2 above, a candidate dossier including all the documents and information described above. Candidates will have to submit their bid uniquely via the dematerialisation platform, at the following address: http://telt.achatpublic.com/accueil/. Each transmission will be associated to a certified receipt date and it will produce an electronic return receipt. The application dossier may include a backup copy, delivered by hand against receipt or sent by express mail with acknowledgement of receipt to the address provided in I.1. All bids, including all backup copies, which are delivered after the date and hour specified will be declared as beyond the deadline and rejected. It is up to the candidates to verify and make sure that their dossier has arrived before the deadline.
Selected candidates shall receive a tender file whereby they shall be invited to submit their bids within a specified timeframe. Thereafter, the successful tenderer of each lot shall be chosen after negotiation, where necessary. It is hereby understood that, pursuant to article R.2161-23 of the Public Procurement Code (former article 74 of Decree n. 2016-360 on public procurement), TELT reserves the right to gradually restrict the number of bidders allowed to negotiate as the negotiation phases unfold.
This contract is subject to :
-italian law n. 191/2009 on construction work items with regard to procedures for financing of the project by the Italian State; these rules will conform to European Union laws and regulations,
- the rules on the fight against Mafia infiltrations agreed by the French and Italian governments and brought into force via the Contract Regulation approved by the CIG (Intergovernmental Commission) and published as part of Decree n. 2017-432 of 5 April 2017 and in force since 9 April 2018, in its consolidated version.
In accordance with article R.2185-1 of the Public Procurement Code (former article 98 of Decree n. 2016-360), candidates and bidders are reminded that the tender can be withdrawn, at any moment of the procedure, up until the signing of the contract. In this case, bidders do not have any right to sign the contract, or to be reimbursed for the expenses they incurred as part of their application. The tender can be withdrawn by the Contracting Entity because of economic, legal, or technical reasons, or following a decision of the two States.
