The following administrative documents shall be provided in English or French:

1. A letter of candidature (or form DC 4* duly completed and signed), giving the name and capacity of the

person authorized to bind the candidate, signed by that person.

2. Where applicable, the mandate or power of attorney granting the power to bind the company to the person

referred to in one (1) above.

3. A declaration signed by the person referred to in one (1) above (or form DC 5* duly completed and signed)

giving:

— Details of overall revenues and revenues from the services to which this contract relates, for

the past 3 financial years,

— The annual average numbers of employees of the candidate,

— A list of the main services provided over the past three years, stating the price, date and

whether for a public or private client.

4. Annual balance sheet accounts for the past three years: candidates that are required by law to draw up

accounts must supply these.

5. Evidence of the candidate's professional qualifications: this may take any form, including references (less

than 3 years old) testifying to its capability to perform the services under the Contract.

6. For candidates in judicial receivership (or, for candidates established abroad, a similar situation): a copy of

the judgment(s) containing the receivership order.

7. A solemn declaration duly dated and signed by the person referred to in 1 above pursuant to article 38 of

Order No. 2005-649 of 6 June 2005 (or form DC 5* duly completed and signed), stating that the candidate:

— Has not, within the past five years, been convicted of any of the offences under articles 222-38, 222-40,

313-1 to 313-3, 314-1 to 314-3, 324-1 to 324-6, 421-2-1, article 421-5 second subparagraph, article 433-

1, article 434-9 second subparagraph, articles 435-2, 441-1 to 441-7, article 441-8 first and second

subparagraphs, article 441-9 or article 450-1 of the French Criminal Code, or under the second

subparagraph of the former article L.152-6 of the French Labour Code (the present article 445-1 of the

Criminal Code) or article 1741 of the General Tax Code, nor been convicted of an offence of the same

kind in another European Union state.

— Has not, within the past five years, been listed in Part 2 of the French criminal records for a conviction for

offences under articles L. 8221.1 or L. 8221-2 (former article L.324-9), L. 8821-3 or L. 8821-5 (former

article L.324-10) L. 8252-1 or L. 5221-8 (former article L.341-6), L. 8231-1 (former L.125-1) or L. 8241-1

(former article L.125-3) of the Labour Code or for offences of the same kind in another European Union

state.

— Has not been placed in judicial liquidation within the meaning of article L.640-1 of the French Commercial

Code or been the subject of an equivalent procedure under foreign law.

— Had as of 31 December 2009 filed all the required tax and social returns and had paid the taxes and

contributions due at that date, or had, before the issue of the present invitation to tender and without any

enforcement proceedings by the auditor or the agency charged with recovery, either discharged those

amounts or given guarantees deemed sufficient by the auditor or recovery agency.

Exécution du marché
Principales conditions de financement et modalités de paiement et/ou référence aux dispositions pertinentes qui les régissent:

A first advance payment of 30 % shall be made upon signature of the Contract, within 30 days from receipt of an invoice.

A second advance payment of 30 % shall be made four months after signature of the Contract, on receipt of all the supporting documentation evidencing the spending of the first advance, together with data entries (including copies of subcontractors' invoices) and within 30 days of receipt of an invoice.

The balance of 20 % at year-end and on receipt of all supporting documentation evidencing the spending of the second advance and the balance together with data entries (including copies of subcontractors' invoices) and within 30 days of receipt of an invoice.
