The civil work detailed design for reinforced concrete concerning the infrastructure of power block (turbine hall and boiler’s building) including basements, the foundations of the dust collector (Electrostatic precipitator), ID Fan and the auxiliary boiler as well as the detailed design studies for reinforced concrete concerning other complete works like the main electrical building, both staircase towers and the secondary electric buildings. These detailed design studies constitute the complete FUS (For Use) engineering documentation necessary for the execution of the civil works, in compliance with the requirements of the Polish regulations concerning the approval procedure by duly authorized entities.

Habilitation à exercer l'activité professionnelle:

To be selected for the Invitation to Tender, the candidates shall answer and submit a Pre-Qualification Questionnaire (PQQ), which is available on the Portail Achats website (www.portail-achats.edf.com) as an attachement in Request for Information (rfi_54303). This questionnaire will be analysed by EDF to assess the capabilities of potential bidders and select them for the Invitation to Tender.

Cannot tender:

1) candidates who were the object, in the last 5 years, of a final judgement for 1 of the infringements envisaged by articles 222-38, 222-40, 313-1 to 313-3, 314-1 to 314-3, 324-1 to 324-6, 421-2-1, 421-5 second subparagraph, 433-1, 433-2 second subparagraph, 434-9 eighth subparagraph, 434-9-1 second subparagraph, 435-3, 435-4, 435-9, 435-10, 441-1 to 441-7, 441-8 first and second subparagraphs, 441-9, 445-1 and 450-1 of the French Penal Code, and by 1741 of the French General Tax Code.

2) candidates who were the object, in the last 5 years, of a judgement registered in the bulletin N°2 of the record for punishments for the infringements mentioned in articles L. 8221-1, L. 8221-3, L. 8221 5, L. 8231-1, L. 8241-1 and L. 8251-1 of the French working law.

3) candidates who are winding up according to the terms of article L640-1 of the Commercial Law, corporations legal entities whose personnel bankruptcy was marked within the meaning of articles L. 653-1 to L. 653-8 of the Commercial Law, as well as the people being the object of an equivalent procedure governed by a foreign law. Candidates admitted with the file for bankruptcy within the meaning of article L631-1 of the Commercial Law, or with an equivalent procedure governed by a foreign law, must justify that they were entitled to continue their activity during the foreseeable duration of the contract and must provide, to support their candidature, the copy of the judgements pronounced for this purpose.

4) candidates who, on 31st December of the year preceding the one of the launching of the consultation, did not sign the declarations about the tax and social matter, or have not discharged the payable taxes and contributions on this date. However, are considered as in a regular situation candidates who, on the 31st of December of the year preceding the one of the launching of the consultation, had not discharged the contributions payable at this date nor generated guaranties, but who, before the launching of the consultation, and without any execution action from the entity responsible for recovery, have either discharged the above mentioned contributions or generated warranties which are estimated sufficient by the entity responsible for recovery. The physical persons which are directing by right or de facto an moral entity not complying with the conditions of this paragraph cannot be personally candidates for this market.

In order to justify he is not in one of the positions listed above, the candidate must provide a dated and signed certificate on the honour. These conditions apply to candidates and to each member of a candidate grouping.

Situation économique et financière:

The candidate shall provide the last 3 financial results and income statements (for French companies, the tax bundle including at least the financial result pages 1 and 2, the income statement pages 3 and 4 and the appendices page 5, 8 and 11). The candidate shall have a turnover amounting at least 4 times the estimated amount of the contract.

The candidate has to submit also a recent financial assessment report made by an independent rating agency stating the company financial risk profile.

The candidate must be able to provide a parent company guarantee if he is not compliant with all these requirements.

Capacité technique et professionnelle:

The candidate certifies to be an engineering design office for the realization of detailed design studies in the field of the civil works and in particular for reinforced concrete studies.

… civil works detailed design studies for projects in Poland, and in particular its capacity to supply drawing and engineering document, including for construction permit purposes, at FUS (For Use) status, according to the requirements of the Polish law for validation by duly authorized and certified in-house persons. The justification of this capacity can be demonstrated by references performed in-house (ie not subcontracted) for similar projects in Poland during the past 5 years. Each of the references provided by the candidate shall at least describe the work made by the candidate as engineering design office, the name and the location of such projects, the name of the Owner/Buyer, the contractual set-up for the realization of such references, the date and the duration of realization as well as the value of the contract in percentage of the global amount of those project. If the candidate does not provide reference, he shall demonstrate he have professional skills, human resources, technical and financial capacity to undertake similar projects.

… civil works detailed design studies for large scale concrete project for power plant construction works. The justification of this capacity can be demonstrated by references performed in-house (ie not subcontracted) during the past 5 years. Each of the references provided by the candidate shall at least describe the work made by the candidate as engineering design office, the name and the location of such projects, the name of the Owner/Buyer, the contractual set-up for the realization of such references, the date and the duration of realization as well as the value of the contract in percentage of the global amount of those project. If the candidate does not provide reference, he shall demonstrate he have professional skills, human resources, technical and financial capacity to undertake similar projects.

… civil works detailed design studies with combined know-how in reinforced concrete and soil/structure interaction. The justification of this capacity can be demonstrated by references performed in-house (ie not subcontracted) during the past 5 years. Each of the references provided by the candidate shall at least describe the work made by the candidate as engineering design office, the name and the location of such projects, the name of the Owner/Buyer, the contractual set-up for the realization of such references, the date and the duration of realization as well as the value of the contract in percentage of the global amount of those project and copies of soil/structure interaction calculations. If the candidate does not provide reference, he shall demonstrate he have professional skills, human resources, technical and financial capacity to undertake similar projects.

… civil works detailed design studies with dynamic calculations of rotating machines’ foundations. The justification of this capacity can be demonstrated by references performed in-house (ie not subcontracted) during the past 5 years. Each of the references provided by the candidate shall at least describe the work made by the candidate as engineering design office, the name and the location of such projects, the name of the Owner/Buyer, the contractual set-up for the realization of such references, the date and the duration of realization as well as the value of the contract in percentage of the global amount of those project, and copies of dynamic calculations for rotating machines’ foundations with soil/structure interface. If the candidate does not provide reference, he shall demonstrate he have professional skills, human resources, technical and financial capacity to undertake similar projects.

… detailed design according to Eurocode (for foundations design also). In particular, the candidate shall demonstrate its capacity to use pressuremeter tests results for foundation design. The justification of this capacity can be demonstrated by references performed in-house (ie not subcontracted) during the past 5 years. Each of the references provided by the candidate shall at least describe the work made by the candidate as engineering design office, the name and the location of such projects, the name of the Owner/Buyer, the contractual set-up for the realization of such references, the date and the duration of realization as well as the value of the contract in percentage of the global amount of those project, and copies of formwork and reinforcement drawings, calculation notes, interface drawings at columns’ base plate, complex examples of construction joints interfaces with reinforcement. If the candidate does not provide reference, he shall demonstrate he have professional skills, human resources, technical and financial capacity to undertake similar projects.

… detailed design for execution of deep foundations diaphragm walls and barrettes. The justification of this capacity can be demonstrated by references performed in-house (ie not subcontracted) during the past 5 years. Each of the references provided by the candidate shall at least describe the work made by the candidate as engineering design office, the name and the location of such projects, the name of the Owner/Buyer, the contractual set-up for the realization of such references, the date and the duration of realization as well as the value of the contract in percentage of the global amount of those project and copies of formwork and reinforcement drawings, calculation notes. If the candidate does not provide reference, he shall demonstrate he have professional skills, human resources, technical and financial capacity to undertake similar projects.

… self-standing reinforced concrete structures whose height is above 50 meters, such as « pylons or stacks (chimneys »). The justification of this capacity can be demonstrated by references performed in-house (ie not subcontracted) during the past 5 years. Each of the references provided by the candidate shall at least describe the work made by the candidate as engineering design office, the name and the location of such projects, the name of the Owner/Buyer, the contractual set-up for the realization of such references, the date and the duration of realization as well as the value of the contract in percentage of the global amount of those project. If the candidate does not provide reference, he shall demonstrate he have professional skills, human resources, technical and financial capacity to undertake similar projects.

The candidate acknowledges that the sub-contracting is forbidden for the realization of civil work engineering studies. The candidate certifies to have enough in-house means and human resources capable to perform the civil works engineering studies Rybnik power plant and demonstrate its capacity to increase its workforce in case of accelerated procedure or in case of delays. The justification of this capacity can be demonstrated by composition of the engineering team, with his staff (managers, engineers, designers, their qualifications, skills and seniority), the dedicated potential composition of the engineering team to undertake the above mentioned studies (as indication, 30 formwork drawings and 300 reinforcement drawings for deep foundations from reception of soil interpretative report and final load distribution, will be required within 6 month including preparation and calculation. First drawing could be expected after 4 month) as well as the software of calculation used in 2D and 3D, the number of posts (post office), the version of the software and numbers of trained persons.

The candidate certifies to have in-house human resources capable to communicate, write and work in English, French and Polish language in the field of engineering studies.

The candidate shall demonstrate having implemented, licensed and maintained…

… a quality management system according to the standard EN ISO9001, or other equivalent systems of quality management. Copies of valid certificate shall be attached by the candidate.

… an environmental management system according to the standard ISO14001 and a health and security management systems according to.

a) OHSAS 18001, or (alternatively),

b) MASE, or (alternatively),

c) VCA or (alternatively),

d) ILOSH - or other equivalent systems of environmental, health and security management. Copies of valid certificate shall be attached by the candidate.

The candidate shall demonstrate having implemented, licensed and maintained an Opqibi certification or any other equivalent certification system for the Civil Work Engineering and special structures. Copies of valid certificate shall be attached by the candidate.

The candidate acknowledges that EDF reserves the right to require complementary capacity information in addition to the above conditions for participation.

EDF reserves the right to request either a performance security, a parent company guaranty, a retention bond or a bank guarantee.

Candidates may be either single companies or consortium. In case the candidate is a joint venture, the copy of the project of joint venture agreement is required.

The capacity required in III.2, Conditions for Participation, will be evaluated jointly.

The form of the consortium shall be joint and several, with a designated leader.
