EDFR is launching a contract notice in order to award and sign a framework agreement for full scope O&M services for onshore wind projects, either already installed and commissioned or to be installed and commissioned during the period covered by the framework agreement, located in Metropolitan France.

The bidders shall provide offers for full scope O&M services with a performance guarantee, and the scope shall include at least: supervision, remote control, preventive maintenance, corrective maintenance (including major components: blades, generator, gearbox, converter, transformer...) and regulatory controls of the wind turbines.

This lot concerns the following platforms: 2MW-Mk10D and Mk11D, 4MW-Mk3A, Mk3B, Mk3E and other new models that will be qualified by EDF Renouvelables during the framework agreement period

The following candidates cannot bid

1) Those candidates who have, within the last 5 years, been handed down a final sentence for one of the offences provided for in Articles 222-34 to 222-40, 225-4-1, 225-4-7, 313-1, 313-3, 314-1, 324-1, 324-5, 324-6, 421-1 to 421-2-4, 421-5, 432-10, 432-11, 432-12 to 432-16, 433-1, 433-2, 434-9, 434-9-1, 435-3, 435-4, 435-9, 435-10, 441-1 to 441-7, 441-9, 445-1 to 445-2-1 or 450-1 of the French Penal Code, Article 1741 to 1743, 1746 or 1747 of the French General Tax Code.

2) Those candidates who have, within the last 3 years, been handed down a final sentence listed on Report No 2 of the Criminal Records Bureau for one of the offences referred to in Articles L. 8221-1, L. 8221-3, L. 8221-5, L.8231-1, L.8241-1, L. 8251-1 and L 8251-2 of the French Labour Code, or for one of the offences provided for in Article L. 1146-1 of the same Code and in Article 225-1 of the French Penal Code. Those candidates who, on 31 December of the year prior to that during which the tender is launched, have not fulfilled their obligations relating to the negotiation obligation provided for in Article L. 2242-1, 2º of the French Labour Code; as well as those candidates who have, within the last 3 years, been handed down a final sentence for the offence referred to in Article 131-39, 5º of the French Penal Code.

3) Those candidates subject to the compulsory liquidation proceedings provided for in Article L. 640-1 of the French Commercial Code, those individuals whose personal bankruptcy has been pronounced under Articles L.653-1 to L. 653-8 of the same Code or those candidates subject to court-supervised administration proceedings provided for in Article L. 631-1 of the French Commercial Code, as well as those candidates subject to equivalent proceedings under a foreign law jurisdiction. However, the following shall be regarded as eligible candidates: those candidates admitted to court-supervised administration proceedings provided for in Article L.631-1 of the French Commercial Code or to equivalent proceedings under a foreign law jurisdiction who provide evidence that they have been authorised to continue their activities throughout the foreseeable term of execution of the contract.

4) Those candidates who had not fulfilled their obligations in terms of tax and social security declarations or had not paid the payable tax and contributions. However, the following shall be regarded as eligible candidates: those candidates who, prior to the date on which the procuring entity determines the candidates’ admissibility, had not paid the various amounts due or provided any guarantees, but who had, without any enforcement measures having been taken by the accountant or the agency responsible for collection, either paid the said amounts or provided guarantees deemed sufficient by the accountant or the agency responsible

5) Those candidates who have been subjected to a measure of exclusion from administrative contracts by virtue of an administrative decision taken in application of Article L. 8272-4 of the French Labour Code.

In order to provide evidence that it is not in one of the situations cited in points 1) to 5) above, the candidate must furnish a sworn statement, dated and signed. For the situations cited in point 4) above, the candidate must also provide the certificates issued by the competent authorities and bodies. For the situations cited in point 3) above, the candidate must also provide an extract from the relevant register, such as a K extract, a K bis extract, a D1 extract or, failing that, an equivalent document issued by the competent judicial or administrative authority of the candidate's country of origin or establishment, attesting to the absence of exclusion.

These conditions are applicable to the candidates and to each of the members of a group wishing to tender as a single candidate.

Situation économique et financière: Documents requested on the procurement portal.
Capacité technique et professionnelle: I. Certifications:

— the candidate shall demonstrate having implemented and maintained…

… a quality management system according to the standard EN ISO9001, or other equivalent system of quality management;

… an environmental management system according to the standard ISO14001, or other equivalent system of environmental management;

… a health and security management systems according to:

(a) OHSAS 18001, or (alternatively);

(b) MASE, or (alternatively);

(d) ILOSH - or other equivalent system of health and security management.

II. H&S KPIs (accidents and incidents):

The candidate shall provide a letter from its chief executive officer or any other duly empowered person certifying that all incidents and accidents reported by all its subcontractors throughout the execution of its contracts are properly registered, followed up, and included in all incidents and accidents statistics provided by the candidate.

III. Sustainable development and applicable law

The candidate must certify, by providing a letter from its chief executive officer or any other duly empowered person, that it will execute all its obligations under potential contracts with EDF Renouvelables France in accordance with:

(i) the principles of the European Directive No 2014/25/UE and its possible transpositions and more generally with;

(ii) all applicable laws.

IV. Human resources

— the candidate certifies to have in-house human resources capable to communicate, write and work in English and in French language in the field of operation and maintenance of WTGs;

— the candidate shall provide proof that it employs in-house human resources duly qualified and trained to maintain WTGs and their various components (first aid training, working at heights and rescue training, LV, MV and HV electrical safety training and authorization for electrical works according to NF C18-510, technical trainings for the maintenance and troubleshooting of the WTGs);

— the candidate certifies to have in-house human resources based in at least 5 different French regions (apart from Ile de France, PACA, Corse).

V. Technical abilities

— the candidate must provide proof that it has at least one operating control center which operates WTGs remotely 24 hours a day and 7 days a week. The candidate shall certify that it has operators capable to communicate in English or French;

— the candidate shall provide proof that it has or will have the relevant access rights for the models of WTG listed in each lot, so that it is able to:

• operate remotely the WTGs: check the status and parameters of the WTGs, troubleshoot failures and remote restart;

• troubleshoot failures and restart WTGs on site;

• manage controllers or change parameters of the WTGs in order to implement scheduled power reduction plan;

— the candidate shall provide such a proof by producing one of the listed items in the procurement portal. If the candidate has or will get relevant accesses (and can prove it) for one or several models of WTGs among all models listed in each lot, it shall specify such models.

The candidate shall demonstrate its capacity to operate and maintain WTGs diligently and quickly by:

• justifying its ability to intervene on site 7 days a week with in-house human resources;

• having at least 5 maintenance locations (where in-house service technicians are based) in at least 5 different French regions (apart from Ile de France, PACA and Corse) and submitting the address and number of permanently employed personnel for each maintenance location;

• having a spare parts storage center located in at least 5 different French regions, or located so that spare parts (excluding major components) can be delivered to the maintenance locations within 6 hours, and submitting the address of each storage location and the global amount of spare parts stored.

Niveau(x) minimal/minimaux de normes:

— The candidate must provide proof that it has performed full scope operation and maintenance contracts on at least 150 WTGs, regardless of the WTG model, in France, during the past 5 years.

The references provided by the candidate shall at least describe the name and location of the wind farm, the model and number of WTGs, the duration of the contract, the scope of activities performed.

If the candidate does not have any reference, it shall demonstrate that it has the professional skills, human resources, technical and financial capacity to undertake such full scope operation and maintenance contracts in Metropolitan France (2 pages max, word or PDF format).

Each framework agreement will be awarded to the most economically advantageous tenders based on criteria that will be indicated in the Invitation to Tender.

Each lot can be awarded to one or more candidates.
