A sworn statement, dated and signed by the party with the authority to bind the candidate, certifying that the latter:

— has, at 31.12.2014, subscribed to the tax and social declarations falling to it and paid the tax and contributions due on this date or, before the launch of this call for tenders, paid these taxes and contributions or constituted guarantees considered to be sufficient by the accountant or the body responsible for collection, under the conditions provided for at article 8-4° of amended order no. 2005-649 of 6.6.2005 relative to the contracts signed by certain public or private entities or individuals not subject to the procurement contract code;

— over the last 5 years has not been the object of a conviction recorded on form no. 2 of the criminal record for the offences referred to in articles L. 8221-1, L. 8221-3, L. 8221-5, L. 8231-1, L. 8241-1 and L. 8251-1 and L. 8251-2 of the French labour code;

Situation économique et financière:

A statement of the candidate's overall annual turnover over the last 3 available years (2012-2013-2014); if the candidate is objectively unable to produce this information, and especially when it is a recently incorporated company, it can provide evidence of its ability by means of any other document considered to be equivalent and in particular by providing an appropriate statement from banks or evidence of professional risk indemnity insurance.

Capacité technique et professionnelle:

A statement indicating the average annual workforce and the part of managerial staff, of R&D staff for the last 3 years (2012-2013-2014);

A presentation of a list of the main Studies and analysis, linked to the contract purpose, performed over the last 3 years (2012-2013-2014), indicating the amount, the date and the public or private recipient.

Exécution du marché
Principales conditions de financement et modalités de paiement et/ou référence aux dispositions pertinentes qui les régissent:

The contracting authority will finance this contract using European funds (regulation no. 377/2014 of the European Parliament and of the Council of 3.4.2014 establishing the Copernicus programme and repealing (EU) regulation no. 911-2010 and more specifically article 8).

The services that are the object of the contract will be paid under the conditions laid down in the SCC and upon presentation of an invoice and will give rise to payment by bank transfer within 30 days maximum as of receipt of the invoice.

Forme juridique que devra revêtir le groupement d'opérateurs économiques attributaire du marché:

Subject to rules relative to the freedom of pricing and competition, candidates can present their application and offer in the form of a short-term consortium between economic actors under the conditions laid down in article 22 of decree no. 2005-1742 of 30.12.2005.

The consortium is considered as joint and severally liable when each member of the consortium is financially committed for the entirety of the contract. The consortium is considered as having joint liability only when each member of the consortium undertakes to perform the services likely to be attributed to it for this contract.

The candidates can present their application and offer in the form of a joint-and-severally-liable consortium or a joint-liability-only consortium. If the contract is awarded to a consortium that has presented its application and offer in the form of a joint-liability-only consortium, said consortium must transform itself into a joint-and-several-liability consortium under the conditions defined in the SCC.

The consortium's representative, named in the deed of commitment from among the members of the consortium, represents all of the members before Mercator Ocean and coordinates their services for the entire duration of the contract.

The candidates' attention is drawn to the fact that one single economic actor cannot represent more than one consortium candidate at a call for tenders. The candidates' attention is also drawn to the fact that in the scope of this call for tenders, one single economic actor is not authorised to present several applications and offers as a member of a consortium and an individual candidate.

The composition of a consortium can only be altered between the date of submission of bids and the date of signature of the contract that the consortium is applying for, if the consortium can provide proof that 1 of its members is placed under judicial liquidation or that it finds itself unable to accomplish its task for reasons beyond its control. In this case, the consortium can request Mercator Ocean's authorisation to continue participating in the call for tenders without this defaulting actor, by proposing, if need be, one or more subcontractors for Mercator Ocean's acceptance.

Mercator Ocean gives its decision on this request after assessing the financial, technical and professional ability of all of the members of the consortium thus changed and, if need be, of the subcontractors presented for its acceptance.
