Liste et brève description des conditions
Pursuant to Articles L. 2141-1, L. 2141-2, L. 2141-3, L. 2141-4, L. 2141-5, L. 2141-7, L. 2141-8, L. 2141-9, L. 2141-10 of the French Public Order Code of December 5th, 2018, the candidate must in support of his application and, in accordance with Articles R. 2143.3, R. 2142-3 and R. 2142-4 of the French Public Order Code of December 5, 2018, produce the following supporting documents:
a) a document relating to the empowerment of persons authorized to bind the candidate (power of attorney),
b) a dated and signed declaration on their honor that they do not fall into any of the cases mentioned in Articles L. 2141-1, L. 2141-2, L. 2141-3, L. 2141-4, L. 2141-5, L. 2141-7, L. 2141-8, L. 2141-9, L. 2141-10 of the aforementioned Public Order Code of December 5, 2018, and in particular that they are in compliance with Articles L.5212-1 to L. 5212-11 of the French Labor Code concerning the employment of disabled workers. This declaration is to be provided by individual candidates, by each member of a candidate group and, if applicable, by the subcontractors presented.
The supporting documents expected are those cited in Articles R. 2143-6 to R. 2143-10 of the Code de la Commande Publique of 5 December 2019. If necessary, the candidate must also produce the documents provided for in articles R. 1263-12, D. 8222-5 or D. 8222-7, or D. 8254-2 to D. 8254-5 of the French Labor Code.
In accordance with the French Public Order Code (“Code de la Commande Publique”) sections R.2143-6 to 10, CNES accepts as sufficient evidence:
1. In order to certify that the applicant is not in the case provided for in articles L.2141-1 and L.2141-4 of the French Public Order Code::
- An extract from the criminal record.
Or, if the applicant is not french
- An extract from a relevant register or, failing that, an equivalent document issued by a competent judicial or administrative authority in his country of origin or establishment.
2. In order to certify that the candidate is not in the case provided for in Article L.2141-2 of the French Public Order Code:
- The certificates issued by the competent administrations and organizations attesting that the declarations in fiscal and social matters have been made and that the taxes, contributions or social security fees due have been paid.
Or, if the applicant is foreign
- A certificate issued by the administrations and organizations of his country of origin or establishment regarding such topic.
3. In order to certify that the candidate is not in the case provided for by article L.2141-3 of the CCP:
- A K extract, or a K bis extract, or a D1 extract.
Or, if he is a foreigner
- An equivalent document issued by a competent judicial or administrative authority of his country of origin or establishment, certifying of the official registration in the country where the company was registrated
Applicants are not required to provide supporting documents and evidence that CNES can obtain through an electronic information system administered by an official body or through a digital storage space, provided that the application file contains all the information required to consult this system or space and that access is free of charge (in this case, specify in your application where to find this information)
CNES verifies the conditions of participation of the candidates in accordance with the procedures provided for in Articles R.2144-1 to R.2144-7 of the Code de la Commande Publique
NB - Documents accompanying the application file written in a foreign language other than French or English will be accepted if accompanied by a translation into French or English
