This Contract notice cancels and replaces the previous notice reference 2014/S 216-382898 published in the Supplement to the Official Journal of the European Union on 8.11.2014 for the ‘Transportation and installation of the Offshore wind turbines on Courseulles-sur-Mer, Fécamp and Saint-Nazaire's offshore wind farms’. Candidates who expressed their interest in the initial Contract notice must confirm and express again their interest in this new contract notice. Submissions and documentary evidences provided for the initial Contract notice remain valid provided that they are compliant with this new contract notice. Therefore, candidates are not obliged to provide them again except in case of change impacting their initial application. A paper version of the documents and the electronic version on a CD or USB key shall be sent to the Contact and postal address of section I.1. All the documents shall be provided in a sealed envelop with the reference of the JOUE contract notice and the object of the contract. The Contract will be governed and ruled by the French Law.

— An administration statement of the company that the work will be achieved by regular workers, according to the laws in effect,

— Attestation of lack of conviction for the last 5 years for professional misconduct of either the company or its managers.

In particular, may not tender:

1) those Candidates who have, within the last 5 years, been handed down a final sentence for 1 of the offences provided for in Articles 222-38, 222-40, 226-13, 313-1 to 313-3, 314-1 to 314-3, 324-1 to 324-6,413-9 to 413-12, 421-1 to 421-2-3, subparagraph 2 of Article 421-5, Article 433-1, subparagraph 2 of Article 433-2, subparagraph 8 of Article 434-9, subparagraph 2 of Article 434-9-1, Articles 435-3, 435-4, 435-9,435-10, 441-1 to 441-7, 441-9, 445-1 and 450-1 of the French Penal Code, Article 1741 of the French General Tax Code and Articles L. 2339-2 to L. 2339-4, L. 2339-11-1 to L. 2339-11-3 of the French Defense Code and L.317-8 of the French Interior Security Code;

2) those Candidates who have, within the last 5 years, been handed down a sentence listed on Report no 2 of the Criminal Records Bureau for the offences referred to in Articles L. 8221-1, L. 8221-3, L. 8221-5, L.8231-1, L. 8241-1, L. 8251-1 and L 8251-2 of the French Labour Code;

3) those Candidates subject to the compulsory liquidation proceedings provided for in Article L. 640-1 of the French Commercial Code, those individuals whose personal bankruptcy has been pronounced under Articles L.653-1 to L. 653-8 of the same Code as well as those persons subject to equivalent proceedings under a foreign law jurisdiction. Candidates admitted to the compulsory reorganisation proceedings laid down by Article L. 631-1 of the French Commercial Code or to equivalent proceedings under a foreign law jurisdiction must provide evidence that they have been authorised to continue their activities throughout the foreseeable term of execution of the contract;

4) those Candidates who, on 31 December of the year prior to that during which the tender is launched, had not fulfilled their obligations in terms of tax and social security declarations or had not paid the tax and contributions payable on that date. However, the following shall be regarded as eligible Candidates: those Candidates who, on 31 December of the year prior to that during which the tender is launched, had not paid the various amounts due on that date or provided any guarantees, but who had, before the date of the launch of the tender and without any enforcement measures having been taken by the accountant or the agency responsible for collection, either paid the said amounts or provided guarantees deemed sufficient by the accountant or the agency responsible for collection. Individuals who are legal or de facto directors of a legal entity that does not satisfy the conditions provided for in this subparagraph may not personally tender for a contract. In order to provide evidence that it is not in one of the situations cited in points 1) to 4) above, the Candidate must furnish a sworn statement, dated and signed.

These conditions are applicable to the Candidates and to each of the members of a group wishing to tender as a single Candidate.

A1. Ownership and corporate structure. If the company is a subsidiary, the name of the parent company and ultimate parent company must be stated as well as the name of a French representative, if any.

— Last 3 financial year's turnover, EBIT, and number of employees in total, as well as for the respective divisions,

— Annual report of the last financial year,

— Declaration that the company neither filled or is involved in insolvency proceedings and that insolvency proceedings have not been refused for lack of assets,

— Rating of an independent rating agency, whose rating is based on relevant European standards or equivalent criteria,

— Proof of valid liability insurance stating the sum insured.

Capacité technique et professionnelle:

Information and formalities necessary for evaluating if the requirements are met: In case of joint ventures or consortiums, Candidates shall indicate which partner has the relevant experience.

In case 1 or several activities listed below were subcontracted, subcontractor shall be described in Candidate's response.

For each of the following items, precise if the activity was solely performed by the Candidate's organization. If not, state which part was performed by a partner of a joint venture or of a consortium (and indicate the name of the partner), or if it was performed by a subcontractor (and indicate the name of the subcontractor). In this(ese) case(s), indicate the part (scope and percentage of the global contract) actually performed by the Candidate and the part (scope and percentage of global contract) performed by the partner and/or subcontractor.

The required information shall include as a minimum the following:

Item DE-1: Load-out, Transportation and installation of offshore wind turbines.

Please provide the following documents/information:

— List of relevant contracts for the past 10 years, specifying for each contract:

— Project name;

— Name and address of client;

— Contract award and completion dates;

— Brief description of the works performed by the Candidate, with information regarding the codes and standards used for the Project;

— Project Execution Plan;

— Planning of the Project;

— Organization chart.

Item DE-2: Design and engineering organization and capabilities

— Engineering management organization plan, team resources (permanent and contracted to be distinguished);

— Main disciplines of the design/engineering department and specialists (relevant for transportation and installation of offshore wind turbines);

— Management of multidisciplinary teams;

— Key employee skills, competencies and experiences you mobilized;

— Engineering manual, list of engineering procedures, sample of procedures, Example of site specific assessment report;

— Engineering review process you apply to control and ensure that engineering is performed as per good industry practice, codes and standards;

Example of a HAZID report:

— Example of final project data book;

— Codes and standards currently used by the design department.

Item C-1: Procurement and fabrication experience related to all equipment and material necessary for the work such as but not limited to seafastening, grillage, lifting appurtenances, etc. Please provide the following document/information:

• Project name,

• Name and address of client,

• Contract award and completion dates,

• Brief description of the works performed by the Candidate, with information regarding the codes and standards used for the Project,

• Typical or sample of seafastening design reports,

• Planning of the supply activities.

Item C-2: Transportation and Installation experience related to offshore works for offshore wind turbines.

• Brief description of the works performed by the Candidate, with information regarding the codes and standards (US, European or others) used for the Project,

• Project Execution Plan,

• Planning of Load-out, Transport and Installation activities,

• Details of methods and means of installation (methods, maritime spreads, logistics, soil conditions, product installed, etc.),

• List of tools, marine assets, facility and/or technical equipments available to the tenderer for carrying out similar contracts,

• Organization chart.

Item M-1: Health and Safety management policy.

— Copy of the Candidate's Health and Safety policy signed by a senior representative;

— Resume of the Candidate's Health and Safety policy showing its main objectives;

— Copy of OHSAS certificate or equivalent. Item M-1: Candidate's accidents statistics;

— Your average statistics for the past 3 years, including:

• Accidents frequency ratio,

• Accidents severity ratio,

Item M-2: Environmental management policy, environmental management system.

— Copy of your Environmental policy signed by a senior representative;

— Summary of your Environmental policy showing its main objectives;

Item M-3: Quality management policy, quality management system.

Please provide the following documents/information describing your quality system:

These conditions will include securities such as an Advance Payment Bond, an on-demand Performance bond and a Parent Company Guarantee.

All the conditions will be detailed in the Contract documents attached to the invitation to tender. Payments will be made according to French law.

Candidates may be either single companies or consortium:

— In case the Candidate is a joint venture, the copy of the project of joint venture agreement is required,

— In case the Candidate is a consortium, a copy of the Memorandum Of Understanding or the project of contract of consortium has to be included. The consortium shall be jointly and severally liable (‘conjoint et solidaire’) or with a jointly liable leader (‘mandataire solidaire’),

— In case the Candidate is a single company, description of qualification and experience of subcontractors (or potential subcontractors) to whom major parts of the works (such as design or installation) are going to be subcontracted, has to be included.

A Tenderer, which will submit an offer as member of a consortium or a joint venture, may not submit an offer as single company or with another consortium or joint venture.
