The following cannot tender:

1) Those candidates who have, within the last five years, been handed down a final sentence for one of the offences provided for in Articles 222-38, 222-40, 226-13, 313-1 to 313-3, 314-1 to 314-3, 324-1 to 324-6, 413-9 to 413-12, 421-1 to 421-2-3, subparagraph two of Article 421-5, Article 433-1, subparagraph two of Article 433-2, subparagraph eight of Article 434-9, subparagraph two of Article 434-9-1, Articles 435-3, 435-4, 435-9, 435-10, 441-1 to 441-7, 441-9, 445-1 and 450-1 of the French Penal Code, Article 1741 of the French General Tax Code and Articles L. 2339-2 to L. 2339-4, L. 2339-11-1 to L. 2339-11-3 of the French Defense Code and L. 317-8 of the French Interior Security Code.

These conditions are applicable to the candidates and to each of the members of a group wishing to tender as a single candidate.

Capacité technique et professionnelle:

1) Candidates shall proof and provide by any means allowing for an assessment of their abilities and, if they have, a list of references over the last 5 years for a similar scope of works shall be submitted by the candidates for the following activities:

a) Rental of floating pumping equipment, filtration and treatment of seawater

b) Management of on-site activities related to floating pumping installations and piping

Those references, or equivalent, shall indicate:

— the client's name and his appreciation of the works or services performed,

— the type of contract (direct/sub-contractor/consortium),

— the object of the contract, name of the project/facility,

— the main features (flow, pressure etc.),

— Original design (name of the manufacturer),

— Date of signature and duration,

— lead times for studies, manufacturing, installation and commissionning.

2) Candidates shall have qualified and duly authorized staff for the installation, supervision and operation of pumping systems (or equivalent)

3) Candidates shall have qualified and duly authorized staff for the preparation, organization and performing of commissioning activities (or equivalent) of such systems

4) Candidates shall be certified according to ISO9001, or shall use a quality management system in accordance with this EU norm, or with equivalent standards. Ongoing certificates will be joined.

5) Candidates shall be certified in the field of Health and Security (OHSAS 18001, MASE, VCA...) and in the field of Environment (ISO 14001), or shall use a management system in accordance with these norms, or equivalent.

6) Candidates shall provide Accident Statistical information for the last three years: frequency rates (total number of accidents, multiply per 1 000 000, over total number of man-hours worked), for its own entities in charge of the work, and for its potential sub-contractors.

7) Candidates shall proof having the resources and facilities to evaluate, control and monitor sub-contractors.
