EDF S.A., and NNB, a British company affiliated, mandating EDF S.A. to act in its own name and its behalf.

The SFCTF includes 2 parts:
— The fixed equipments: rails and lateral guiding rails, docking flange of the penetration, biological lid handling station, manoeuvring system for the upper cover of the penetration,
— The mobile part: the spent fuel cask transfer machine (trolley).
There is 1 contract per lot:
1) UK 2621 (UK lot) studies, supply, manufacturing, test, transport, erection and commissioning of spent fuel cask transfer facility (SFCTF), for:
— Hinckley Point nuclear power plant, 2 units are firm (2 units of fixed equipment and 1 trolley),
— other nuclear power plants in the UK, 2 units are optional:
a) Option 1: supply one set fixed equipments and one trolley, including, the design, the supply, the manufacturing, the tests, the transport, the erection and the commissioning for an other site in UK,
b) Option 2: supply one set fixed equipments, including, the design, the supply, the manufacturing, the tests, the transport, the erection and the commissioning for a second EPR unit. The supply of another trolley depends on the choice of the site (if it is the same site as the option 1, the trolley is not required).

Conditions de participation
Habilitation à exercer l'activité professionnelle:

To be selected for the invitation to tender, the candidates shall answer and submit a pre-qualification questionnaire (PQQ), which is available on the portail achats website (www.portail-achats.edf.com) as an attachement in request for information (rfi_52946).

This questionnaire will be analysed by EDF to assess the capabilities of potential bidders and select them for the ITT.

In addition to the documents required in the PQQ, the company shall provide:

— the administrative certificate proving that the company is up to date of its taxes payment,

— a certificate delivered by the organisation of covering certifying that the payment of the national insurance contributions is up to date taking into consideration payment (EEC) n°1408-71 of the 14.6.1971,

— a certificate on the honor which guarantees that works will be performed with employees legally employed, taking into consideration articles L143-3, L143-5 and L620-3 and article R341-36 of the French working law considering the use of foreign workers or equivalent,

— a certificate from a insurance certifying that it guaranteed the pecuniary consequences of civil responsability,

— a certificate on the honor which guarantees, for the last 5 years, the absence of judgment registered on the bulletin n° 2 of the police record or infringements aimed to Articles L324-9, L341-6, L125-1 and L125-3 of the French working law or equivalent.

When a document or a certificate is not issued by the country concerned, it can be replaced by a declaration under oath or a solemn declaration, made by the economic operator party whith a legal or administrative authority, a notary or any other qualified authority of the state concerned. These documents or certificates, if they are not written in French or English, must be accompanied by a translation in one of these language.

Cannot tender:

1) candidates who were the object, in the last 5 years, of a final judgement for one of the infringements envisaged by articles 222-38, 222-40, 313-1 to 313-3, 314-1 to 314-3, 324-1 to 324-6, 421-2-1, 421-5 second subparagraph, 433-1, 433-2 second subparagraph, 434-9 eighth subparagraph, 434-9-1 second subparagraph, 435-3, 435-4, 435-9, 435-10, 441-1 to 441-7, 441-8 first and second subparagraphs, 441-9, 445-1 and 450-1 of the French Penal Code, and by 1741 of the French General Tax Code;

2) candidates who were the object, in the last 5 years, of a judgement registered in the bulletin N° 2 of the record for punishments for the infringements mentioned in articles L. 8221-1, L. 8221-3, L. 8221-5, L. 8231-1, L. 8241-1 and L. 8251-1 of the French working law;

3) candidates who are winding up according to the terms of article L640-1 of the Commercial Law, corporations legal entities whose personnel bankruptcy was marked within the meaning of articles L. 653-1 to L. 653-8 of the Commercial Law, as well as the people being the object of an equivalent procedure governed by a foreign law. Candidates admitted with the file for bankruptcy within the meaning of article L631-1 of the Commercial Law, or with an equivalent procedure governed by a foreign law, must justify that they were entitled to continue their activity during the foreseeable duration of the contract and must provide, to support their candidature, the copy of the judgements pronounced for this purpose;

4) Candidates who, on 31st December of the year preceding the one of the launching of the consultation, did not sign the declarations about the tax and social matter, or have not discharged the payable taxes and contributions on this date. However, are considered as in a regular situation candidates who, on the 31st of December of the year preceding the one of the launching of the consultation, had not discharged the contributions payable at this date nor generated guaranties, but who, before the launching of the consultation, and without any execution action from the entity responsible for recovery, have either discharged the above mentioned contributions or generated warranties which are estimated sufficient by the entity responsible for recovery. The physical persons which are directing by right or de facto an moral entity not complying with the conditions of this paragraph cannot be personally candidates for this market.

In order to justify he is not in one of the positions listed above, the candidate must provide a dated and signed certificate on the honour. These conditions apply to candidates and to each member of a candidate grouping.

Situation économique et financière:

The tenderer shall provide the last 3 financial results and income statements (for French companies, the tax bundle including at least the financial result pages 1 and 2, the income statement pages 3 and 4 and the appendices page 5, 8 and 11). The tenderer shall have a turnover amounting at least 15 000 000 EUR for each of the last 2 years. The tenderer must be able to provide a parent company guarantee if he is not compliant with all these requirements.

Capacité technique et professionnelle:

The following information and formalities are necessary for evaluating if the requirements are met (if applicable):

1) The applicant should demonstrate its capability, for example by presenting recent experiences in manufacturing for nuclear spent fuel cask transfer facility - more than 100 t on tailways (trolley), including by providing information here below:

— scope of works and contract references,

— nature and volume of the works, capacities and characteristics of the installed trolleys,

— details of project scheduling (of studies, manufacturing, delivery, installation, etc...),

— customer details (name and phone number),

— specify/highlight in house realised part of the project and information concerning the subcontracted part of the scope of works.

If you demonstrate your capability by presenting experiences, these experiences should not be dated less than 5 years.

2) To provide its manufacturing capabilities for 2 SFCTFs simultaneously;

3) To demonstrate its in house or subcontracted capacities for the following topics:

— welding capacities,

— handling capacities,

— manufacturing personnel (number of experienced workers, qualification, etc...).

4) To demonstrate its ability to design studies meeting the specific requirements of the UK&PY3 spend fuel cask transfer facility: handling calculation following KTA requirements seismic calculations;

5) To demonstrate its capability in design, supply, installation, commissioning on material and system that follow complex processes and that moves on railways. These demonstrations will need to concern systems that handle nuclear fuel charges heavier than 100 tons and including instrumentation & control;

6) To fully demonstrate its cability in design and installation of special piping following the RCC-M requirements, and in radiological studies. If you demonstrate your capability by presenting experiences, these experiences should not be dated less than 5 years;

7) ISO 9001 and ISO 14001 (or equivalent management system). Provide approved and valid certificates;

8) People that will work on site installation shall speak, read and understand English for the UK lots, and French for the French lot

Nota: if all the above mentioned capabilities are not in house, the company should demonstrate the capacity of its subcontractors and/or partners. This nota does not apply to criteria relating to design.
