Conditions de participation
Habilitation à exercer l'activité professionnelle:

To be selected for the invitation to tender, the candidates shall answer and submit a pre-qualification questionnaire (PQQ), which is available on the portail achats website (www.portail-achats.edf.com) as an attachement in request for information through the free access part (rfi 53135).

This questionnaire will be analysed by EDF to assess the capabilities of potential bidders and select them for the ITT stage.

The new candidatures should be completed with all required documentation (including PQQ).

In addition to the documents required in the PQQ, the company shall provide:

— the administrative certificate proving that the company is up to date of its taxes payment,

— a certificate delivered by the organisation of covering certifying that the payment of the national insurance contributions is up to date taking into consideration payment (EEC) No 1408-71 of the 14.6.1971,

— a certificate on the honor which guarantees that works will be performed with employees legally employed, taking into consideration articles L143-3, L143-5 and L620-3 and article R341-36 of the French working law concerning the use of foreign workers or equivalent,

— a certificate from a insurance company certifying that it guaranteed the pecuniary consequences of civil responsibility,

— a certificate on the honor which guarantees, for the last 5 years, the absence of judgement registered on the bulletin N°2 of the police record for infringements aimed to articles L324-9, L341-6, L125-1 and L125-3 of the French working law or equivalent.

When a document or a certificate is not issued by the country concerned, it can be replaced by a declaration under oath or a solemn declaration, made by the economic operator party with a legal or administrative authority, a notary or any other qualified authority of the state concerned. These documents or certificates, if they are not written in French or English, must be accompanied by a translation in one of these language.

Cannot tender:

1) candidates who were the object, in the last 5 years, of a final judgement for one of the infringements envisaged by articles 222-38, 222-40, 313-1 to 313-3, 314-1 to 314-3, 324-1 to 324-6, 421-2-1, 421-5 second subparagraph, 433-1, 433-2 second subparagraph, 434-9 eighth subparagraph, 434-9-1 second subparagraph, 435-3, 435-4, 435-9, 435-10, 441-1 to 441-7, 441-8 first and second subparagraphs, 441-9, 445-1 and 450-1 of the French penal code, and by 1741 of the French general tax code;

2) candidates who were the object, in the last 5 years, of a judgement registered in the bulletin N°2 of the record for punishments for the infringements mentioned in articles L. 8221-1, L. 8221-3, L. 8221-5, L. 8231-1, L. 8241-1 and L. 8251-1 of the French working law;

3) candidates who are winding up according to the terms of article L640-1 of the commercial law, corporations legal entities whose personnel bankruptcy was marked within the meaning of articles L. 653-1 to L. 653-8 of the commercial law, as well as the people being the object of an equivalent procedure governed by a foreign law.

Candidates admitted with the file for bankruptcy within the meaning of article L631-1 of the commercial law, or with an equivalent procedure governed by a foreign law, must justify that they were entitled to continue their activity during the foreseeable duration of the contract and must provide, to support their candidature, the copy of the judgements pronounced for this purpose.

4) Candidates who, on 31st December of the year preceding the one of the launching of the consultation, did not sign the declarations about the tax and social matter, or have not discharged the payable taxes and contributions on this date.

However, are considered as in a regular situation candidates who, on the 31st of December of the year preceding the one of the launching of the consultation, had not discharged the contributions payable at this date nor generated guaranties, but who, before the launching of the consultation, and without any execution action from the entity responsible for recovery, have either discharged the above mentioned contributions or generated warranties which are estimated sufficient by the entity responsible for recovery.

The physical persons which are directing by right or de facto an moral entity not complying with the conditions of this paragraph cannot be personally candidates for this market.

In order to justify he is not in one of the positions listed above, the candidate must provide a dated and signed sworn statement.

These conditions apply to candidates and to each member of a JV, consortium or any other form of arrangement.

Situation économique et financière:

The tenderer shall provide the last three financial results and income statements (for French companies, the tax bundle including at least the financial result page 1 and 2, the income statement pages 3 and 4 and the appendices page 5,8 and 11).

Depending on the lots he wants to tender upon, the tenderer shall have a minimum turnover of 4 000 000 EUR/ year for Penly lot, 6 000 000 EUR/ year for UK, 10 000 000 EUR/ year for both UK and Penly.

Capacité technique et professionnelle:

The supplier shall:

) Demonstrate his in-house or subcontracted capabilities for the implementation of:

A turnkey contract for an industrial process for the treatment of solid radioactive waste including:

— Design studies,

— Procurement of equipment,

— Manufacture,

— Factory acceptance tests,

— Transportation,

— Erection,

— Commissioning.

Or a turnkey contract for an industrial process with similar requirements:

— Formulation of cement for encapsulation of filters and capping of concrete drums,

— Operation of the encapsulation process from a control panel (remotely controlled),

— Compaction of waste sacks (dry active waste < 2mSv/h) into metallic or HDPE drums (200 litres),

— Shredding of metallic or HDPE drums containing waste.

(< 2mSv/h).

— Conformity verification system for waste sacks (including glove box, dose rate machine, x-ray machine),

— Tipper to transfer waste from one level of the building to another,

— Shielded windows for operators protection that allows visual checks of process operation,

— Handling and lifting of concrete drums (both horizontal and vertical transfer required during the encapsulation process), (approx. 10 T),

— Control panels,

— Shielded doors (leak tightness requirements),

— Treatment of resins into "big bags" or metallic drums,

— Filtration and decanting systems.

The supplier will demonstrate his experience, in particular:

— Scope of works and contract experience of similar projects,

— Type of service provided, equipment characteristics,

— Codes and standards (calculation types etc.),

— Programme,

— Customer details (name and phone number),

— Work carried out "in-house" and "sub-contracted" (% of workload).

Experience must be recent, i.e. during the last 5 years.

2) Demonstrate his ability to perform calculations and / or tests in accordance with the standards and codes in force. Provide details of the resources (staff: number, seniority, SQEP) and associated software systems available.

3) Provide details of his design resources (staff: number, seniority, SQEP) and equipment availablen, for manufacturing, erection, installation and commissioning

4) Be certified ISO 9001 (vs 2000) or equivalent management system and ISO 14001 or equivalent management system

5) Have the PDMS licence/SQEP operators at the time of contract endorsement and be able to work with it

6) Demonstrate his capability to communicate in French and English (written and spoken word).

NB: if the above-mentioned capabilities are not "in house", the company shall demonstrate the capacity of its sub-contractors and/or partners. The company shall provide details of the monitoring process/procedures put in place and provide details showing how the subcontractor or partner meets the above-mentioned requirements.

A candidate may not submit a bid for this tender on its own behalf as a single company and at the same time with one or more other companies acting in joint venture, consortium, partnership or otherwise.
